These Terms and Conditions establish the agreement between the traveler and Touramericas, applicable to all bookings and arrangements.

1. VALID IDENTIFICATION

Travelers of all ages must possess a valid passport or government-issued ID at the time of booking. IDs must remain valid for at least six (6) months beyond the itinerary’s return date.

2. HEALTH AND MOBILITY

Travelers must disclose any health or mobility concerns that may affect their participation. Touramericas reserves the right to exclude individuals if their condition disrupts the tour experience.

3. REPRESENTATION AND BOOKING

Bookings are only accepted through the website’s Tour Booking Form submission. Invoices, valid for 48 hours, are issued within 24 hours. Bookings made within 10 days of the tour may incur a surcharge.

4. PAYMENTS, CANCELLATION, AND REFUNDS

Cancellation policies are detailed on the specific tour page. Refund eligibility requires cancellation notice by 10:00 AM EST on the final day of the cancellation window, per the tour’s policy. A $45 fee applies to international wire refunds.

  • Accepted Payment Methods: Zelle, wire transfers, and in-person check deposits at Bank of America branches.
  • Not Accepted: Checks sent by mail to Touramericas offices.

5. TOUR PRICING, INCLUSIONS, AND EXCLUSIONS

Tour prices cover land-based costs and exclude airfare unless specified on the tour page. Travelers are responsible for arranging flights, including those necessary for participation. Detailed inclusions and exclusions are listed on the tour page; no refunds will be provided for unused services.

6. TRAVELER’S RESPONSIBILITIES

Travelers must review their Confirmation Voucher and all documentation upon receipt. Any errors must be reported to Touramericas within 24 hours. Touramericas is not liable for discrepancies reported after this period.

7. SPECIAL REQUESTS

Travelers should inform Touramericas of any special requirements at booking. While efforts will be made to accommodate, fulfillment cannot be guaranteed, and Touramericas assumes no liability for unmet requests.

8. INSURANCE REQUIREMENTS

Comprehensive travel insurance is strongly recommended to cover trip cancellations, interruptions, medical emergencies, evacuations, repatriations, and other unforeseen incidents during the tour.

9. ACCEPTANCE OF SERVICES

Payment for any tour or service indicates acceptance of these Terms and Conditions and accompanying pre-departure documentation.

10. COMPLAINTS AND NOTIFICATIONS

Travelers must immediately inform Touramericas of any issues during the tour to ensure timely resolution and documentation.

11. LIABILITY AND COLLABORATION

Touramericas works with registered wholesalers to provide services. The tour operator manages accommodations, transportation, and itinerary logistics. Touramericas is not liable for:

  • Special needs assistance.
  • Loss of valuables or personal items.
  • Damages caused by customers.
  • Itinerary changes or delays caused by external factors like weather or traffic.

In case of issues, Touramericas will mediate with the operator to find resolutions.

12. TOUR CANCELLATION

If a tour is canceled without the traveler’s fault, Touramericas will refund all payments for unprovided services unless otherwise directed in writing by the traveler. Airfare payments are non-refundable. If payments have been remitted to third-party providers who default, Touramericas will supply proof of payment and registration records of the provider.

13. RESPONSIBILITY DISCLAIMER, INDEMNIFICATION, AND LIABILITY RELEASE

Touramericas does not own or manage service providers and disclaims liability for their performance. Travelers release Touramericas from liability for any claims or damages arising from the tour, except in cases of proven negligence. Touramericas’ liability is limited to the amount paid for the tour.

14. WARRANTIES AND ASSUMPTION OF RISKS

All services are provided “as is,” with no guarantees of quality, reliability, or suitability. Travelers accept all risks, including hazards of travel, accommodation, transportation, and conditions in the destination country.

15. THIRD-PARTY RIGHTS AND GOVERNING LAW

These Terms apply only to the traveler and Touramericas, creating no rights for third parties. The laws of Florida govern these Terms, excluding conflict of laws principles.

16. DISPUTE RESOLUTION

All disputes are subject to binding arbitration in Florida under the American Arbitration Association’s Commercial Arbitration Rules. Travelers waive their right to a jury trial and punitive damages.

17. ENTIRE AGREEMENT

These Terms and accompanying pre-departure documents constitute the full agreement between Touramericas and the traveler, overriding any prior agreements.
